Johnny Depp and Amber Heard's legal battle continues and it looks like the actor is now winning. A judge has shut down the actress' move to throw out her former husband's lawsuit in the Virginia court, which means the trial will push through.

Heard has tried a number of attempts to dismiss the case, but it has been repeatedly denied. In fact, her legal counsel has filed for its dismissal three times, but to no avail.

Cinemablend noted the "Aquaman" star hoped that the ruling of London Judge Andrew Nicol last year could help dismiss the 58-year-old actor's defamation lawsuit in Virginia. However, Fairfax County Chief Judge Penney Azcarate did not agree.

Nicol ruled out that the 2018 article of The Sun that called Depp a "wife-beater" was not "libelous." It also claimed that the "great majority" of Heard's domestic abuse claims "could be proved to the civil standard," USA Today cited.

Though the two lawsuits tackle the same issues about the "Pirates of the Caribbean" star's alleged domestic abuse, they have different sets of statements. This is probably why Azcarate denied the request of Heard's camp, per CourtHouse News Service.

So, the case is now scheduled for trial in Fairfax County in 2022. Depp and his lawyer, Ben Chew, can now continue to challenge Heard's claims against the former.

However, the London trial may still have a factor in the defamation case. The 35-year-old star's legal team may try its best to use its verdict as legally as possible to show that Depp is abusive.

For starters, Depp sued The Sun for naming him a "wife-beater." The London judge pronounced the claims true, but it was largely based on Heard's testimony. From here, the "Edward Scissorhands" star filed a defamation case after his ex-wife claimed she was a survivor of domestic abuse in a Washington Post op-ed.

Meanwhile, as Heard and Depp's legal battle remains, the latter's fans also continuously show their support. It gives birth to the prevalent use of the hashtags #JusticeForJohnnyDepp and #FireAmberHeard, making it a trend on social media.

They want "The Stand" star to be out of the DC Extended Universe movie Aquaman and the Lost Kingdom, the sequel of the 2018 Aquaman, directed by James Wan. As part of his lawsuit, Depp claimed he is a victim of "false allegations to generate positive publicity" so that Heard can advance her career, stressing she is not a victim of abuse but a perpetrator.
